錦坤學(xué)術(shù) - 上海錦坤律師事務(wù)所民事組律師第二輪研討會圓滿召開 The 2nd round group study session of civil lawyers of Shanghai JinKun Law Firm was successfully held
2021年02月19日周五下午13點(diǎn)，錦坤所民事組第二次研討會在大會議室圓滿召開。會議由錦坤所合伙人別律師主持,民事組團(tuán)隊(duì)骨干律師以及實(shí)習(xí)生共聚于此。未能到場與會的律師以及實(shí)習(xí)生，通過線上方式參與研討會。本次研討會依舊延續(xù)上一輪不動產(chǎn)繼承糾紛案例，基于民法典相關(guān)規(guī)定，從案件爭議焦點(diǎn)、原被告雙方權(quán)利義務(wù)深入討論。
On the 19th day of February 2021，the second round group study session of civil lawyers was successfully held in the JINKUN’s meeting room. Mr. BIE, an attorney-at-law and a partner of Shanghai JinKun Law Firm, ran this discussion. His practice focuses on Civil Procedure Law. Some lawyers and interns were participated in this discussion, and others who were not able to attend this discussion participated online. This discussion talked about the same real estate inheritance case as the last meeting. The lawyers listed the focuses of the disputes and discussed the rights and obligations of the both parties based on the Civil Code.
會議開始，錦坤所合伙人別律師首先分享了自己對于案件的處理方式，以及新舊法之間，對于不動產(chǎn)糾紛的訴訟策略之異同。
At the beginning of the meeting, lawyer BIE shared his treatment methods on the similar cases. After compared the new Civil Code with the Property Law, lawyer BIE set forth his own views.
隨后，錦坤所民事組林聯(lián)紅律師發(fā)表了自己對于案件中不動產(chǎn)產(chǎn)權(quán)歸屬問題的觀點(diǎn)并結(jié)合事實(shí)和法律依據(jù)，特別詳述了對現(xiàn)有庭審筆錄的分析?？偨Y(jié)了案件的爭議焦點(diǎn)以及相應(yīng)的辯護(hù)意見。
According to the facts and law, lawyer LinLianhong expressed her views on the ownership of the apartment, and analyzed the court record. She also summarized the focus of the dispute and the corresponding defense opinions.
最后，錦坤所民事組王瑞赟實(shí)習(xí)律師總結(jié)了上述倆位律師的觀點(diǎn)，并提出了新的角度——社會效應(yīng)。如果不合理的訴求被法院支持，是對于公眾底線的突破，是對于社會公序良俗的挑戰(zhàn)。
Finally, Mr. WangRuiyun, a trainee of Shanghai JinKun law firm, summarized the views of the above two lawyers and put forward a new perspective -- social effect. If an unreasonable claim is supported by the people’s court, it will be a significant breakthrough to the citizens’ bottom line and a grand challenge to the Public order and Borus mores.
在自由討論階段，別律師對實(shí)習(xí)生律師及實(shí)習(xí)生真誠指點(diǎn)，這讓他們受益良多。
In the stage of Q&A, lawyer BIE gave trainees and interns some advices, which benefits them a lot.
