錦坤快訊｜上海錦坤律師事務所參加Moot Shanghai 2021并擔任賽事仲裁評委
2021年3月8日至3月12日，Moot Shanghai 2021國際模擬商事仲裁庭上海邀請賽在線上舉行。作為Willem C. Vis International Commercial Arbitration Moot（簡稱“28th Vis Moot”）全球季前賽之一，共有來自全球22個法域的60支知名院校的400多名學生正式參賽，250多來自普通法系和大陸法系的仲裁員、執(zhí)業(yè)律師擔任本次賽事的仲裁評審。本屆賽事由華東政法大學、上海政法學院共同舉辦，上海國際仲裁中心(SHIAC)和國際商會(ICC)聯(lián)合主辦。
Moot Shanghai 2021 International Simulated Commercial Arbitral Tribunal Shanghai Invitational Contest held online from March 8 to March 12. As one of the Willem C. Vis International Commercial Arbitration Moot ("28th Vis Moot ") global preseason competitions, the competition attracts a lot of universities from around the world.
錦坤所的樊延軍律師、徐寶同律師向大賽組委會申請作為此次賽事的仲裁員，他們憑借各自優(yōu)秀的國際仲裁業(yè)務能力，被大賽組委會選定為仲裁員，與世界各國其他法律工作者一起，對各國參賽選手的比賽表現(xiàn)進行評判。在此次賽事中，樊律師和徐律師參與和旁觀了共計5場賽事，分別從選手的表達能力、辯論邏輯、準備工作和回答技巧四個方面進行評分。
Lawyer Fan Yanjun and Lawyer Xu Baotong from JINKUN Law Firm were selected as arbitrators by the Organizing Committee with their excellent abilities. With careful preparation and active participation, JINKUN Law Firm and two lawyers, together with other legal workers from all over the world, evaluated the performance of the contestants from all over the world.
樊延軍律師表示，在全世界新冠肺炎大流行的情況下，中國還能組織如此盛大的比賽，這是中國一流組織能力的體現(xiàn)。大賽的選題結合新冠肺炎和知識產權等方面，與當下熱點聯(lián)系緊密。組織者和參賽者都很年輕，能力都很強，令人印象深刻。希望更多人加入MOOT Shanghai,通過我們共同的堅持和努力，讓國際法律的舞臺上有越來越多的中國面孔，也讓中國企業(yè)和公民“走出去”的時候，始終有我們卓越的國家化法律人才陪伴，為其護航遠行。
Lawyer Fan said that the fact that China was able to organize such a big event in the face of the worldwide COVID-19 pandemic was a sign of the country's first-class organizational capabilities. he topic selection of the competition is closely related to the current hot topics in terms of COVID-19 and intellectual property. The organizers and the contestants are very young and very capable, and they are very impressive.
徐律師表示，之前也做過跨境商事仲裁，對新加坡國際仲裁中心和香港國際仲裁中心的規(guī)則和法律都有一定的了解。此次Moot Shanghai邀請賽對在校的法學學生和做國際商事仲裁的執(zhí)業(yè)律師來說，都是一次鍛煉學習的機會，有助于各位參賽的學生和法律工作者熟悉英美法律的邏輯和辯論思路。他還提到，此次賽事的參加，為錦坤后續(xù)處理不同國家的商事仲裁糾紛積累了經驗。
Lawyer Xu said that he had done cross-border commercial arbitration before, and had a certain understanding of the rules and laws of Singapore International Arbitration Center and Hong Kong International Arbitration Center. The Moot Shanghai Invitational is an opportunity for both law students and professional lawyers engaged in international commercial arbitration to practice and learn. This will help students and legal professionals to familiarize themselves with the logic and debating ideas of Anglo-American law.Lawyer Xu also said that the participation in this competition has accumulated experience for Jin Kun to deal with commercial arbitration disputes in different countries in the future.
